Prosecutors have less than 60 days to decide whether they will pursue the death penalty for Lori Vallow, the Idaho mom accused of murdering her children over doomsday ideas of demons and zombies.

District Judge Steven Boyce has scheduled the jury trial to begin in Boise on Oct. 11, with a scheduled completion date of Dec. 16, according to paperwork filed Wednesday.

Vallow and husband Chad Daybell were originally supposed to stand trial together, but Vallow declined to waive her right to a speedy trial, meaning the court could not wait around for Daybell’s January date. Boyce denied a request to sever the trials last month when asked by Daybell’s lawyer.

Prosecutors previously said they will seek the death penalty for Daybell for his “especially heinous, atrocious or cruel” crimes and his “propensity to commit murder, which will probably constitute a continuing threat to society.”

After finally being declared competent to stand trial, Vallow appeared in court Tuesday and pleaded not guilty to all charges, including the first-degree murder of JJ Vallow, Tylee Ryan and Daybell’s late wife, Tammy.

The bodies of her children were found on Daybell’s property near Rexburg, Idaho, in June 2020, nine months after they were reported missing. In the intervening months, Vallow had vanished to Hawaii, where she and Daybell wed in November 2019.

Vallow has also been indicted for conspiracy to commit murder in Arizona in the death of her fourth husband, Charles Vallow, who was fatally shot by her brother, Alex Cox, in July 2019. Cox died in December 2019 from what was ruled a blood clot .

In his divorce filings, Charles Vallow accused his wife of becoming “infatuated at times obsessive about near death experiences and spiritual visions.” He also claimed Lori had threatened to kill him “if he got in her way” during her mission as a God “to carry out the work of the 144,000 at Christ’s second coming in July 2020,” according to court documents, and that Lori claimed to have “an angel there to help her dispose of the body.”

Vallow’s Arizona trial is not expected to begin until after the Idaho trial has wrapped.
