The Oxford Community School District and school principals are also mentioned in the list. lawsuit. Mary and Matthew Mueller, the parents of the injured child, say the school district and its staff have failed to address the serious issues surrounding shooter Ethan Crumbly. More than a dozen students have already filed a similar federal lawsuit against the school district and some high school employees.

This new lawsuit, filed by the Mueller family, seeks damages and damages from the school district, its employees, and Acme Shooting Goods, LLC. They say their son, referred to only as “EM” in the lawsuit, received a gunshot wound to his hand and face, resulting in serious injuries and long-term damage.

“While we will live with the horror of that day forever, he will live with the physical pain and trauma of being shot for the rest of his life. This pain could have been avoided,” Matthew and Mary Mueller said in a statement. “We are bringing this costume so that the failures both in the sale of this weapon and in our school that allowed this to happen will never happen again. No family or community should experience this pain, and no child should live with it all their lives. for the rest of your life.”

It shields them from liability for a wide range of federal and state complaints. according to Giffords, a gun control organization..

In any event, this has not stopped the families of the victims of the shooting and pro-gun control groups from suing gun manufacturers and dealers. Gun control group Brady, whose legal arm is behind the Mueller case, along with law firm Sommers Schwartz, court cases in 40 states According to senior lawyer Erin Davis, for many years against arms dealers and manufacturers.

Several families in Connecticut who lost children in the mass shooting at Sandy Hook Elementary School successfully sued gun manufacturer Remington. This year, four Remington insurance companies have agreed to pay out $73 million as a result of the lawsuit. The case alleged that a gun manufacturer sold guns in a way that violated state consumer protection law and placed profit over public safety.

At least one parent whose child was killed in the Robb Elementary School shooting in Uvalde, Texas, has begun litigation with arms manufacturer Daniel Defense, which produced the AR-15 type rifle used in the massacre.

Davis told NPR that she believes Brady has created a “robust body of case law” in other legal battles, giving this lawsuit a greater chance of success.

The lawsuit, filed by the Mueller family, alleges negligence on the part of both the school district and Acme.

It alleges that the dealer sold the pistol to Crumbley’s father “despite factual and/or constructive knowledge that the father was involved in the illegal purchase of straw … and that the Acme pistol was intended for the shooter.”

A straw purchase is when a person buys a weapon on behalf of someone else while falsely claiming to be buying it for themselves. According to the lawsuit, both Crumbly and his father made comments at Acme’s store indicating that the gun was actually meant for the then 15-year-old. The salesman sold the gun to his father anyway.

Crumbly’s parents have since faced criminal charges for the November 30, 2021 assault. Crumbley has been charged with murder and other crimes and plans to appear in court in an insanity case. His parents, James and Jennifer Crumbly, pleaded not guilty to four counts of manslaughter.
